Administrative Order 00-5: Assignment of Lawyer Magistrate to Collect Fines and Reimbursements Still Due and Owing in Inactive Felony Cases in Gem County

Whereas, from time to time, the District Judges in the Third Judicial District have imposed fines or other reimbursement charges that have not been collected during an active probation or parole in felony cases, and that there is no resident District Judge in Gem County, and

Whereas, the restitution officers in the Third Judicial District typically utilize the services of the Magistrate Division of the District Court to collect the bulk of the fines and reimbursements that remain unpaid, and

Whereas, the courts of this state have inherent and legislative authority to enforce their orders in accordance with Idaho Code sections 1-1603 and 1-1901, and finally,

Whereas, judgments for fines and reimbursements imposed in criminal actions may be enforced as in civil matters in accordance with Idaho Code sections 19-2703 and 19-2518, which may further be enforced by contempt proceedings in accordance with Idaho Code section 7-601(5),

Now, therefore, this Orders that Judge Gordon W. Petrie, a Magistrate Judge of the Third Judicial District, may be assigned to collect fines and reimbursements that remain due and owing in inactive felony matters in the District Court of Gem County where no active probation or parole exists, provided further, the aggregate amount for fines or reimbursements outstanding for any one defendant does not exceed $10,000.00.
