Whereas,
the rate of compensation for court-appointed counsel was established on April
1, 1997 at $50 per hour, and
Whereas,
the increase of the cost of living and the cost necessary to maintain the
practice of law since that amount was established renders the amount of $50 per
hour an inadequate sum for compensation and could raise concerns about the
adequacy of counsel being furnished to indigent defendants, and
Whereas,
certain judges in the Third Judicial District have met with reluctance by an
increasing number of counsel to continue to accept court-appointed assignments
at the $50 per hour rate;
Now,
therefore, IT IS HEREBY ORDERED that effective October 1, 2006, that in the
absence of a specific order of the court fixing a different rate of
compensation, the rate of compensation for court-appointed attorneys for
indigent defendants shall be the sum of $70 per hour.
IT
IS FURTHER ORDERED that any restitution ordered to be repaid by the defendant
for court-appointed counsel will be based on a rate of $70 per hour absent a
specific order of court to the contrary.
