Whereas, this
Court previously entered Administrative Orders 2007-2 on February 9, 2007 and 2007-3
on March 29, 2007 that governed the procedures for the processing of
misdemeanor citations and arraignments and
Whereas, the
Canyon County Clerk’s Office has requested guidelines for the appointment
of a public defender attorney on misdemeanor cases which will allow the
arraignment clerks to immediately approve or deny a request for a public
defender appointment without seeking a judge’s approval for each request;
Now, therefore, it
is hereby Ordered that the Canyon County Clerk’s
Office can approve or deny a request for a public defender appointment pursuant
to the Attachment “A” to this order.

In determining the family size, include the defendant, spouse,
and the number of children the defendant is supporting.
If the defendant’s income is between the income ranges on
the chart, the application must be given to a judge for approval.
Automatic public defender appointment for any defendant who is receiving any Health and Welfare services or are
receiving Social Security Supplemental Income (SSI), Social Security Disability
(SSD) or Social Security Income.
Except, no public
defender appointments for first time (no priors) minor in
consumption/possession of alcohol and passing school bus violations.
