Order 10-9: Approval
of the Southwest Idaho
Juvenile Detention
Center , Pursuant to Idaho
Whereas,
in 1990, Canyon, Gem, Owyhee, Payette and Washington Counties entered into a
Joint Powers Agreement for the Establishment and Management of a juvenile
detention center, the Southwest Idaho Juvenile Detention Center; and
Whereas,
the Joint Powers Agreement created a Joint Policy Board to govern the operation
of the
Whereas,
the Joint Policy Board and aforementioned counties have, in compliance with the
terms of the Joint Powers Agreement, determined to dissolve the Agreement; and
Whereas,
as a result of such dissolution,
Whereas,
it appears that the Southwest Idaho Juvenile Detention Center has been operated
in compliance with Idaho Code Section 20-518 and that Canyon County has
committed to continue operation of the Southwest Idaho Juvenile Detention
Center in compliance with Idaho Code Section 20-518; and
Whereas,
Canyon County will provide an annual budget presentation and an operations
briefing to the Court, at least annually and as otherwise requested, and will
ensure that the facility is available for inspection by the Court, upon
reasonable notice,
It
is Therefore Ordered that pursuant to Idaho Code Section 20-517(1) the
Southwest Idaho Juvenile Detention Center is approved as a detention facility
for juvenile residents of counties within the Third Judicial District, provided
that the Southwest Idaho Juvenile Detention Center continues to comply with the
requirements of Idaho Code Section 20-518 and any other statutes, rules and
regulations governing such detention center unless otherwise ordered by the
Court.
