Whereas
the Canyon County Clerk has retained an independent contractor, nextScan, Inc.; President Kurt Breish;
690 S. Industrial Way, Ste. 10; Meridian, Idaho to scan archived court files
from its current microfilm technology to digital technology;
Whereas
Idaho Code section 9-331A (2) provides that a county officer may retain a
document in a different form or medium from that in which it is received,
provided that the form or medium in which the document is retained results in a
permanent record which may be accurately reproduced during the period for which
the document must be retained;
Whereas
Idaho Code section 9-331A (4) requires that all documents received by a county
officer be retained in a system which is secure against unauthorized or undetected
alteration or deletion of data, and which provides for periodic backup of data
for off-site storage and that said system permit the documentation to be
readily and intelligibly reproduced on paper;
Whereas
Idaho Code sections 9-940A, 9-940B, 9-940C, 9-940D, 9-940E, 9-940F and 9-940G
provide that certain records or other documents contained within court files
are confidential and exempt from public disclosure;
It
is Hereby Ordered Adjudged and Decreed that the Canyon County Clerk and the
above referenced independent contractor and its employees are authorized to
convert all archived court files currently maintained on microfilm technology
to digital technology so long as all parties are in complete compliance with
the above cited sections of the Idaho Code.
