Administrative Order 91-11: Consolidating Felony and Misdemeanor Cases

Whereas duplication, delay, and lack of due process may result when misdemeanor and felony charges arising from a single or related incident are treated separately,

It is hereby ordered that whenever a defendant is charged with both a felony(ies) and a misdemeanor(s) arising from a single or related incident, the cases shall be consolidated by the Magistrate at the defendant's first appearance.

It is further ordered that if the defendant is bound over to the District Court on the felony charge(s), the consolidated misdemeanor charge(s) shall also be transferred to District Court.
