Administrative Order 93-8:
Establishing
Recognizance Release Standards for Certain Misdemeanor Offenses
for Adams, Gem, Owyhee, Payette, and Washington Counties
It is hereby ordered in all
counties of the Third Judicial District without a Pre-Trial
Release Officer operating under direct court supervision that law
enforcement agencies are authorized to adopt a policy of
recognizance release immediately following booking for those
persons whose identities can be verified and who are charged only
with the following crimes:
- minor in possession of
alcohol or tobacco (18-1502)
- person under the age
of 21 forbidden to enter, remain in or loiter at places
licensed for the sale of liquor (23-943)
- person under the age
of 21 not allowed to purchase, possess, serve, dispense
or consume beer, wine or other alcoholic liquor (23-949)
- no valid driver's
license (49-301)
- failure to carry
driver's license (49-316)
- expired driver's
license (49-319)
- failure to carry
registration (49-427)
- failure to display
license plate (49-428)
- failure of nonresident
to register vehicle operated in Idaho (49-432)
- failure to sign
registration (49-442)
- operating a vehicle
without registration (49-456)
- fictitious display of
license plates (49-456{2})
- lending or permitting
another to use registration or license plate (49-456{3})
- all city or county
open container ordinance violations
- any other city or
county ordinance violation
