Administrative Order 94-3: Establishment of a Presumption in the Magistrates Division that Sentences are to be Served Concurrently Unless Otherwise Ordered

Whereas there has been confusion at the county jails in interpreting judgments as to whether or not sentences are to be served consecutively or concurrently and

Whereas it appears that applicable case law is split on whether sentences are presumed to be consecutive or concurrent where the intent of the judge is not clear,

It is hereby ordered that the presumption in the magistrates division shall be that separate jail sentences are to be served concurrently unless the judgment provides otherwise.
