Administrative Order 94-7: Increasing the Civil Jurisdiction Limits of Cases Assignable to Attorney Magistrates

Whereas Rule 82(c)(2) of the Idaho Rules of Civil Procedure provides that the administrative district judge of a judicial district may approve the assignment of additional cases to attorney magistrates, and

Whereas only the Third Judicial District has maintained a $5,000 limit on magistrate judge civil jurisdiction, and

Whereas increasing magistrate judge civil jurisdiction in the Third Judicial District would make such jurisdiction uniform throughout the State of Idaho and would assist in the uniform administration of justice,

It is hereby ordered that the civil actions, regardless of the nature of the action, where the amount of damages or value of the property claimed does not exceed $10,000 shall be assignable to the attorney magistrates of the Third Judicial District commencing on January 3, 1995.

Dated this 6th day of October, 1994.

Signed by Dennis E. Goff, Administrative District Judge
