Administrative Order 95-3: Provision of Court Security Services to the District and Magistrate Courts in Gem County

Whereas there is an established record of violent incidents which have occurred in courthouses throughout the country and in this judicial district which have endangered the public safety, and

Whereas special security precautions have been taken for the past several months by the Gem County Sheriff's Department on Tuesday afternoons and at any time a domestic violence hearing is held in the magistrates division, which have proven to be effective in stemming the occurrence of violent incidents, and

Whereas the Gem County Magistrate Judge has been notified that the aforementioned security services will no longer be customarily provided as has been the case in the past, and

Whereas Idaho Code section 31-2202 provides in part that the sheriff shall "[a]ttend all courts, including the magistrate's division of the district court when ordered by a district judge, at their respective terms held within his county, and obey the lawful orders and directions of the courts,"

Now, therefore, it is hereby ordered that the Gem County Sheriff shall continue to provide the customary court security services to the Gem County Magistrates Division on Tuesday afternoons, at all domestic violence hearings, and at such other times and places as may be deemed necessary by this Court, or in the alternative that all courts in Gem County be attended by the sheriff whenever in session for any reason.
