Administrative Order 95-5: Establishment of a Uniform System for the Qualification and Approval of Persons, Agencies, or Organizations to Perform Evaluations Required by Idaho Code section 18-918(5)

Whereas Idaho Code section 18-918 has been amended by the Idaho Legislature to require, as of July 1, 1995, that any person who pleads guilty or is found guilty of domestic assault or domestic battery shall, prior to the imposition of sentence by the court, undergo an evaluation to determine whether the defendant should be required to obtain aggression counseling or other appropriate treatment for anger control and prevention, and

Whereas Idaho Code section 18-918(5)(c) provides that each judicial district shall, by rule, establish a uniform system for the qualification and approval of persons, agencies, or organizations to perform those evaluations required by this section, and

Whereas this judicial district supports the concept that any system of qualification for the performance of such evaluations should be uniform throughout the State of Idaho, and

Whereas this judicial district has been advised that the Idaho Supreme Court plans to establish and maintain a statewide uniform system for the qualification and approval of persons, agencies, or organizations to perform those evaluations required by Idaho Code section 18-918(5),

Now, therefore, it is hereby ordered as follows:

1. That this Judicial District does hereby adopt as its own that Supreme Court Rule, and any subsequent amendments thereto, which establishes a uniform system for the qualification and approval of persons, agencies, or organizations to perform those evaluations required by Idaho Code section 18-918(5); and

2. That pending final approval and implementation of such a Rule by the Idaho Supreme Court, the following persons shall be considered qualified to perform in this judicial district those evaluations required by Idaho Code section 18-918:

  1. Idaho-licensed psychiatrists,
  2. Idaho-licensed psychologists,
  3. Idaho-licensed professional counselors, and
  4. Idaho-licensed social workers who are certified to provide private counseling services; and

3. That this Order shall be effective July 1, 1995 and shall terminate without further notice upon approval and implementation by the Idaho Supreme Court of a Rule establishing a uniform system for the qualification and approval of persons, agencies, or organizations to perform those evaluations required by Idaho Code section 18-918(5).
