Administrative Order 97-4: Substitution of Wiebe & Fouser for Van Bishop Law Office as Canyon County Public Defender

Whereas, by private contract, Van Bishop Law Office acted as the public defender in all indigent criminal cases up until October 1, 1997, and

Whereas, effective October 1, 1997, the contract public defender is the firm of Wiebe & Fouser, Attorneys at Law, in all indigent criminal cases and under the contract with Canyon County agreed to take over the representation in all cases where a public defender was appointed and the matter is still pending, and

Whereas the record in each case needs to be amended in order to show Wiebe & Fouser as the attorney of record instead of Van Bishop Law Office,

Now, therefore, it is hereby ordered that the firm of Wiebe & Fouser be substituted as public defender in all cases in which Van Bishop Law Office was representing the defendant as the public defender and which was not thereafter reassigned by Van Bishop Law Office to a conflict attorney.

It is further ordered that it be deemed that a copy of this order be filed in each indigent criminal case and that service of process may be made upon Wiebe & Fouser even though the case file may indicate that Van Bishop Law Office is the appointed attorney.

Dated this 6th day of October, 1997.

Signed by Gerald L. Weston, Administrative District Judge
